Social Security Disability Court Hearings and Appeals
Most Social Security Disability claims are denied at the initial stage. The good news is that a denial is not the end of the road—you have the right to appeal. At California Disability Advocates, we represent clients through every step of the appeals process, including court hearings before an Administrative Law Judge (ALJ). With more than 30 years of experience, our team knows what it takes to turn a denial into an approval.
The Appeals Process
If your application or reconsideration has been denied, you have 60 days from the date of notice to file an appeal. This request can be filed under:
Title II (SSDI) – Social Security Disability Insurance
Title XVI (SSI) – Supplemental Security Income
Or both, if applicable.
Your case will then be scheduled for a hearing before an Administrative Law Judge who had no involvement in the earlier decision.
What Happens at a Social Security Hearing?
A Social Security disability hearing is your chance to tell your story and explain how your condition prevents you from working. Here’s what to expect:
The Judge’s Questions: The ALJ will ask you questions about your medical condition, work history, and daily limitations.
Witness Testimony: You may bring witnesses who can speak about your condition.
Experts: Medical and vocational experts may also testify.
Length of Hearing: Most hearings last between 15 minutes and one hour.
While this may sound straightforward, success often depends on having the right representative on your side.
Why You Need Representation
Attending a hearing without an experienced disability advocate is a serious risk. Here’s how our team strengthens your case:
File Review: We carefully analyze your claim to identify why you were denied.
Evidence Gathering: We ensure all relevant medical records and supporting documents are added to your file.
Case Theory: We present a clear, compelling argument to show that you meet the Social Security Administration’s definition of disability.
Cross-Examination: Our advocates know how to challenge testimony from medical or vocational experts to protect your rights.
Our experience allows us to highlight the strongest aspects of your claim and address any weaknesses before the judge.
